GENERAL TERMS AND CONDITIONS OF SALE
CONDITIONS OF THE EXCURSION
Voile Tradition Marseille (VTM) reserves the right to modify itineraries or cancel services in the event of adverse weather conditions. Only the captain is authorized to assess navigation conditions and may cancel a maritime service. In the event of cancellation by Voile Tradition Marseille (VTM), passengers may either be refunded or have their excursion rescheduled to another date, subject to their agreement.
Swimming is permitted during stopovers under your own responsibility. The provision of swimming equipment shall in no way be considered as a supervised nautical activity.
Passengers agree, in all cases, to comply with the rules on board the vessels established by Voile Tradition Marseille (VTM), as well as to follow the orders of the captain and crew. Passengers must present themselves 15 minutes before the scheduled departure time. No refund will be granted in case of passenger delay.
CANCELLATION POLICY – PRIVATE CHARTERS –
By Voile Tradition Marseille (VTM):
If, due to adverse weather conditions, the excursion cannot take place — at the sole discretion of the owner or captain — all amounts already paid will be fully refunded, with no charges retained.
By the customer:
If canceled at least 1 month prior to the excursion date, the deposit will be refunded in full, with no fees retained.
If canceled between 15 days and 1 month prior to the excursion, the deposit will not be refunded (up to 30% of the total excursion price).
If canceled less than 15 days prior to the excursion, all amounts already paid shall be retained.
CANCELLATION POLICY – TICKETED EXCURSIONS –
By Voile Tradition Marseille (VTM):
– Proposed change of itinerary
Weather conditions may prevent the standard route but still allow for a pleasant navigation in another direction. In such cases, the captain and the VTM team may propose an alternative itinerary prior to departure.
If the customer accepts the change, they will participate in the full excursion and no refund or reduction may be claimed afterward.
If the customer refuses, they will not participate and will receive a full refund.
If, due to adverse weather conditions, the excursion cannot take place at all, all sums paid will be fully refunded, with no charges retained.
By the customer:
If canceled at least 1 week prior to the excursion, a full refund will be issued.
If canceled between 6 and 3 days before the excursion, 50% of the amount paid will be retained.
If canceled less than 48 hours before the excursion, all amounts already paid shall be retained.
ELECTRONIC TICKET (for ticketed excursions)
The electronic ticket is a dematerialized ticket. For all bookings, you must present the booking confirmation document (the confirmation email), which serves as the electronic ticket.
TRANSPORT TICKET AND ACCEPTANCE OF CONTRACTUAL CONDITIONS
Booking online on the Voile Tradition Marseille (VTM) website constitutes a contract implying full acceptance of these General Terms and Conditions of Sale and Transport by all participants in the nautical and aquatic activities for whom the reservation has been made.
The electronic ticket, which corresponds to the online (or email) confirmation of your booking by Voile Tradition Marseille (VTM), is personal and non-transferable. It must be kept by the customer who made the online booking for themselves and/or other participants.
PASSENGERS’ HEALTH CONDITIONS
Passengers must inform Voile Tradition Marseille (VTM) of any contraindication or inability preventing them from safely participating in the offered services (nautical activities: maritime excursions, water sports, swimming, snorkeling, etc.).
Passengers embark under their own responsibility and cannot hold Voile Tradition Marseille (VTM) liable for bodily injury related to their health condition (disability, illness, etc.), whether on board, during embarkation/disembarkation, or during nautical or aquatic activities.
Passengers requiring special assistance due to health conditions (reduced mobility, visually impaired, etc.) must notify VTM staff at the time of booking and embarkation.
PREGNANT WOMEN
Pregnant women may participate in a sea excursion under their own responsibility.
However, they cannot hold Voile Tradition Marseille (VTM) liable for any bodily injury or incident related to pregnancy.
MINORS
Voile Tradition Marseille (VTM) does not transport unaccompanied minors. They must embark and participate in excursions, as well as nautical or aquatic activities, under the sole responsibility of their accompanying adult(s).
For children under 2 years old, wearing an appropriate life jacket is mandatory. Parents must notify VTM of their child’s presence when booking or prior to embarkation.
PASSENGERS’ BEHAVIOR
Passengers must remain seated during navigation. They must comply during embarkation, disembarkation, and throughout the excursion with the vessel’s regulations, in particular those established by VTM, as well as all instructions from the captain and crew.
Voile Tradition Marseille (VTM) declines all liability for bodily injuries occurring due to non-compliance with these rules.
Passengers will be held responsible for any damage of any kind caused to themselves, to other passengers, to third parties, or to VTM’s staff and property. The same applies to damage caused by persons or belongings under their supervision.
Swimming is allowed during “swimming breaks” in the calanques, but it is unsupervised and under passengers’ sole responsibility. Minors remain under the responsibility of their accompanying adult(s). Non-swimmers or poor swimmers must notify the crew. VTM provides flotation devices and life jackets but declines liability for incidents or injuries occurring during swimming.
BODILY INJURY
Any injury or damage occurring during excursions or nautical activities must be reported to VTM staff before leaving the vessel. Otherwise, passengers are presumed to have disembarked safe and sound, with belongings in good condition.
Outside the provisions of Articles L5421-2 and following of the French Transport Code, Voile Tradition Marseille (VTM) declines liability for bodily injury occurring during navigation, excursions, nautical activities, or embarkation/disembarkation operations, whether at ports of departure, destination, stopovers, or at sea during swimming.
PERSONAL ITEMS AND EQUIPMENT
Passengers may bring personal equipment (camera, mask, snorkel, fins) under their own responsibility.
Voile Tradition Marseille (VTM) declines all liability for passengers’ luggage, belongings, valuables (cash, jewelry, etc.), which remain under their owners’ exclusive responsibility during excursions or activities.
LOAN OF EQUIPMENT
Voile Tradition Marseille (VTM) may provide equipment free of charge (fins, masks, snorkels, windbreakers, etc.) within the scope of its activities.
Any defect in such equipment does not entitle passengers to any refund or discount.
VTM reserves the right to take legal action against passengers who deliberately damage loaned equipment.
ORGANIZATION OF FESTIVE EXCURSIONS
During festive excursions organized by VTM (cocktail cruises, calanques parties, bachelor/bachelorette events, etc.), moderate consumption of alcohol and tobacco is permitted.
For safety and passenger comfort, VTM staff may restrict or prohibit alcohol, tobacco, or drug use.
VTM reserves the right to disembark any passenger whose behavior endangers others, causes damage, prevents staff from performing their duties, or disrupts the safety and comfort of others.
FINANCIAL TERMS
Service descriptions on the Website specify, for each service, what is included in the price. Prices are indicated in Euros. Prices are shown either inclusive of VAT (TTC) or exclusive of VAT (HT), as stated in the quotation.
Ticketed excursions: Prices include VAT at 10%.
Private charters:
Cruises on predefined routes are subject to VAT at 10%.
Tailor-made events are subject to VAT at 20%.
Payments are made online by credit card (Carte Bleue, Visa, Mastercard, American Express) via a secure payment system.
In the event of irregular, incomplete, or failed payment for reasons attributable to you, the sale will be canceled, with any costs charged to you. Civil and/or criminal proceedings may be initiated if applicable.
INTELLECTUAL PROPERTY
Voile Tradition Marseille (VTM) holds all intellectual property rights related to the Website. Access to the Website does not confer any rights to such intellectual property, which remains the exclusive property of VTM.
No part of the Website (texts, photos, images, icons, sounds, videos, software, databases, etc.) may be reproduced, transmitted, published, or used in any form without VTM’s prior written authorization.
DELAYS
As a transport company, we are committed to strict schedules to ensure a pleasant experience for all passengers. Departures take place at the scheduled time, and passengers must be at the embarkation point 10 minutes before departure.
In case of delay:
Please notify us by phone as soon as possible.
Provide your estimated arrival time.
If your delay exceeds 10 minutes, the vessel will depart without you, and no refund or rescheduling will be possible.
VTM cannot be held responsible for external transport issues (traffic jams, train/metro delays, etc.).
We rely on your punctuality to ensure smooth sailing for everyone.
